Most people rarely, if ever, are forced to deal with life-altering events. As a law firm specializing in personal injury litigation, we deal with tragic life-altering events every day. Every once in a while, however, our law firm is able to not only help our clients make the best out of a life-altering situation, but we are able to effect change; the kind of change that helps ensure that others will not fall victim to the same atrocities that impact our clients’ lives.

For many in the Las Vegas valley, one of those life-altering events occurred on February 27, 2008. It was on this day that the Southern Nevada Health District (“SNHD”) began sending out over 60,000 letters to individuals notifying them that they were potentially exposed to Hepatitis C, Hepatitis B or HIV as a result of an endoscopic procedure performed on them at the Endoscopy Center of Southern Nevada. Time essentially stood still as many valley residents anxiously waited for the results of the blood tests indicating whether or not they had contracted Hepatitis or HIV. Most valley residents were able to breathe a sigh of relief when their results came back negative, but for dozens of others, they were informed that they had contracted Hepatitis C.

A number of those valley residents infected with Hepatitis C as a result of their procedure at the Endoscopy Center have explained that this disease has impacted every aspect of their life, as Hepatitis C is a disease that has no cure. Some infected residents have explained that because of the disease, they are unable to hug their grandchildren because they are afraid of possibly infecting them. Others have explained that they can no longer sleep with their spouse and that any form of intimacy they used to have has since diminished as a result of the disease. A consistent theme from valley residents inflicted with Hepatitis C is that their lives will never be the same because of the social stigma that they now suffer from.

As the news of the outbreak spread, residents of the valley became outraged and the valley’s eyes turned to the legal system for answers. The District Attorney’s office filed criminal charges against Doctor Desai and a number of other individuals directly involved with the outbreak. Multiple grand juries have been convened and have ultimately indicted Doctor Desai and others for murder, fraud and conspiracy. A number of civil lawsuits have been filed against medical professionals, drug companies, and insurance companies. As a result of the aforementioned legal proceedings, a number of individuals and corporations were forced to file for bankruptcy. Every part of Nevada’s legal system has been inundated with all types of challenges. Calls from those residents affected by the outbreak have become commonplace at our office and being in a position to effect change we knew we had to do our part to prevent such outbreaks from occurring again in the future.

As the legal proceedings began and further investigations were conducted, the injection practices at the Endoscopy Centers became the center of attention and ultimately, the SNHD’s investigation concluded that the unsafe injection practice at the Endoscopy Centers was the cause of the Hepatitis C outbreak. In fact, the injection practices at the Endoscopy Centers and the Hepatitis C outbreak in Las Vegas even drew national attention from the Centers for Disease Control and Prevention (“CDC”). After the outbreak, the CDC began implementing the One and Only Campaign in hospitals and ambulatory surgery centers all across the country. This campaign reminded medical providers that to prevent infections, it is important to only use one needle and one syringe once. There can be little doubt that the breadth of the Las Vegas outbreak has encouraged change in medical communities across the country.

Despite the tragedy that has affected so many, some gratification can be garnered in the changes made to injection practices across the United States. Being in a position to effect change in the community and in our clients’ lives is gratifying and fulfilling. This provides the motivation and is truly the driving force behind what we strive to accomplish as a law firm.

Red Rock Fertility Offers Egg-Freezing Promotion in Recognition of Infertility Week

LAS VEGAS – In recognition of National Infertility Awareness Week from April 20 to 26, Red Rock Fertility will offer a special promotion to help women prepare for having children later in life. The leading Las Vegas fertility practice is offering $1,000 off egg-freezing services from April 20 through July 1 to assist women with planning ahead to achieve pregnancy. The full price of the service is $7,500. During the promotion, the price will total $6,500.

Oocyte Cryopreservation, also known as egg freezing, preserves a woman’s mature eggs following hormone stimulation. The process preserves women’s fertility in order to achieve pregnancy at an older age, providing an important option for women planning to wait until later in life to build a family. Older women have a lower chance of achieving pregnancy, as egg reserves decrease significantly with age. Women diagnosed with cancer also utilize the egg-freezing services to avoid losing their egg reserves as a side effect of treatments such as chemotherapy, radiation and surgery.

“Many women are now waiting until later in life to have children, and egg freezing provides an insurance plan for having children in the future,” said Dr. Eva Littman, founder and practice director of Red Rock Fertility. “Red Rock Fertility strives to provide women with healthy and innovative options for building families, and we encourage women to explore our egg-freezing services as an option to help them achieve pregnancy in the future.”

Red Rock Fertility will also offer free follicle-stimulating hormone (FSH) blood tests during the promotion period. The clinic provides FSH blood tests to help evaluate the health of women’s reproductive systems and diagnose issues such as infertility.

National Infertility Awareness Week, founded by the National Infertility Association in 1989, aims to raise awareness about the disease of infertility and further encourage members of the public to understand their own reproductive health. Infertility, the inability to achieve pregnancy, can be caused by health issues among both men and women.

Infertility affects 7.3 million people in the U.S., or one in eight couples, according to the 2002 National Survey of Family Growth by the Centers for Disease Control and Prevention. In addition, a couple within the age range of 29 to 33 years old with a normal reproductive system has only a 20 to 25 percent chance of conceiving in any given month, according to the National Women’s Health Resource Center.

Several SBA Loan Requirements Eliminated

The U.S. Small Business Administration made significant changes in qualification for SBA 504 loans.

The changes include elimination of “the personal resource test” and “the nine-month rule”. These modifications mean businesses will have an easier time qualifying for SBA loans, according to a recent statement by TMC Financing.

“By eliminating the nine-month rule for expenditures, businesses that have previous expenditures for building improvements more than nine months from the time of the loan can apply them towards their down payment,” said Ann Santiago, senior vice president for TMC Financing in Las Vegas. She added that the elimination of the personal resource test also removed an obstacle that previously could restrict some businesses owners from obtaining SBA 504 loans.

HealthCare Partners Nevada, a leading medical network across Southern Nevada, will provide flu shots for community members during a flu shot clinic from 9 a.m. to 3 p.m. on Oct. 18 at the organization’s Siena clinic. Community members can attend the event to receive their annual flu vaccine.

In addition to flu vaccinations, HealthCare Partners will provide tours of the clinic during the event. The organization will also continue to distribute free tickets to the public for a Four Tops concert on Saturday night at the South Point Arena, which HealthCare Partners is hosting with Humana. The concert corresponds with the Fun After 55 Expo, a free, daylong health fair starting at 10 a.m. on Saturday at the South Point Arena that will offer information about how to stay healthy and active after the age of 55.

Fall marks the beginning of flu season, so it is highly important for community members to protect themselves with a flu shot this time of year. HealthCare Partners is providing flu clinics throughout Southern Nevada this season as part of its Total Care Model, a team-based approach to health care that strongly focuses on prevention. The organization also seeks to educate community members about their health care options by providing free tours of the local clinic.

Individuals 65 and older are at high risk of developing serious flu-related complications, according to the Centers for Disease Control and Prevention. It is estimated that 90 percent of seasonal flu-related deaths in the U.S. occur among people 65 and older, as a result of seniors’ weakened immune systems.

Solutions Recovery’s Brings Awareness to Addiction Myths That Can Sabotage Recovery

Premier addiction recovery center breaks addiction stereotypes that stigmatize a successful rehabilitation with educational events

LAS VEGAS — Solutions Recovery Inc., a leading addiction treatment center in Las Vegas, brings awareness to several myths about addiction that can undermine recovery through its ongoing education Lunch and Learn educational awareness event at their Wellness Campus. On Friday, Feb. 26 from 12 to 1 p.m., Holly Davis, clinical professional counselor-intern for Solutions Recovery, will discuss the reasoning behind addiction myths and stereotypes as well as how these can impede the progress of an individual’s recovery. Solutions Recovery aims to bring attention to the truth behind addiction as well as debunking these myths through their work with clients and ongoing educational programs.

“It’s about combatting the stigma,” said Davis. “We’re seeing very few people suffering from symptoms of addiction seeking treatment. We need to teach these individuals how to advocate for themselves.”

According to the Centers for Disease Control and Prevention (CDC), 6 people a day die from alcohol poisoning in this country. The pandemic doesn’t just stop there, though as Davis notes, illicit drug use is on the rise especially among prescription drugs and heroin. The CDC recently noted that heroin deaths are up 289 percent since 2002.

The stigma begins with myths surrounding the idea of addiction, including the idea that addiction is a choice or that people get addicted to one type of substance. According to the National Institute of Drug Abuse (NIDA), those who suffer from alcohol use disorders are “18 times more likely to use other drugs like prescription drugs.” In 2015, approximately 4 million women and 5 million men reported misuse of prescription pain medicines, this doesn’t include the number of individuals who are also addicted to alcohol or illegal drugs.

“Unfortunately, many individuals seeking addiction rehabilitation are hindered by the stigmas set aside by society,” said David Marlon, president of Solutions Recovery. “It’s imperative that we dissolve the predetermined misconceptions behind addiction and open the lines of communication to provide those seeking recovery access to the best help possible.”

Another one of the biggest myths is believing that those addicted to prescription drugs fit within specific stereotypes than those addicted to illegal substances. NIDA notes that there were 24.6 million individuals aged 12 and older who used illicit drugs in 2013.

“Addiction doesn’t discriminate between one individual over another,” said Marlon. “Addiction is a chronic disease of the brain and it does not differentiate between a person’s sex, culture, ethnicity or class.”

Good Deed Brings Cool Relief to Las Vegas Homeowner

Jean Jackson is a 94-year-old Las Vegan who was relying on a two window air conditioners to cool her one bedroom trailer during Nevada’s brutally hot summerJean Jackson is a spry 94-year-old Las Vegan who was relying on a two small, barely functioning window air conditioners to cool her one bedroom trailer during Nevada’s brutally hot summer. When they wore out and failed, she knew she was in trouble.

Jackson’s original air conditioners were so old they couldn’t be replaced; they aren’t made anymore. What’s worse, Jackson’s home, where she’s lived for 33 years, needed rewiring to support a newer system. Because she was living off of Social Security, the cost of putting in that system was prohibitive.

For older adults, living in Las Vegas’ summer heat without air conditioning can be dangerous. The Centers for Disease Control and Prevention say older adults don’t adjust as easily to changes in temperature as younger people and are likelier to have chronic medical conditions that change normal body responses to heat, something Jackson knows well.

Jackson has been hospitalized from heatstroke in the past, and when her air conditioning unit died, paramedics suggested she move to a nursing home or deal with the risk of heatstroke.

“It’s hard to deal with this weather,” Jackson said. “It was too hot and I had to go to the hospital because they thought I had heatstroke,”

So Goettl Air Conditioning and its sister company The Sunny Plumber, led by owner Ken Goodrich, reached out to the Clark County Social Service Department and got connected with Jackson.
“I think it’s incumbent on all businesspeople to look after their community,” Goodrich said, “and to give back to people who are less fortunate.”

The Sunny Plumber fixed Jackson’s water line, while Goettl Air Conditioning, with help of Daikin-Goodman Global, created a custom mini-split unit for Jackson’s home, a system that will let her cool her house in the summer and warm it in the winter.

If Jackson had been paying for the work done on her home, it would have cost her almost $14,000.

“You always have to be grateful and these people have no idea how grateful I am for their help at my home,” Jackson said. “It’s a godsend.”

The work will let her keep her home and her independence.

“I don’t want to move and I don’t want to go to a nursing home,” she said. “As long as I can keep my independence, I will be happy.”

With Overdose Death Rates on the Rise Westcare Expands Services Offering Over 180 Programs Nationwide

WestCare continues to expanded services nationwide to address the American addiction epidemic has never been more at the forefront of national attention.LAS VEGAS – The American addiction epidemic has never been more at the forefront of national attention, and according to data recently released by the Centers for Disease Control and Prevention (CDC), the problem continues to worsen. To address the growing epidemic, WestCare continues to expanded services nationwide.

“This crisis is decimating families and entire communities,” said Richard Steinberg, President and CEO of WestCare. “Addiction is a preventable and treatable disease. With adequate resources we can address this devastating illness and help individuals, families, and communities begin to heal.”

With over 180 programs in 18 states, three U.S. Territories and Palau, WestCare is helping thousands of individuals annually and will continue to grow based upon the need. During the 2016/2017 Fiscal Year, WestCare received funding and had opportunities for program expansion across the globe including:

  • In California, WestCare expanded corrections-based substance use disorder treatment services in four new geographic services areas.
  • As part of a federally-funded demonstration pilot project, WestCare Nevada was selected as a providers to work collaboratively to establish Nevada’s first Certified Community Behavioral Health Clinic models.
